Buying a Domain Name
When you purchase a domain name you are actually buying the right to use the domain for a set period of time (as shown by the Expiry Date on the Nominet WHOIS) and you need to keep renewing the domain if you wish to keep using it. If you do not renew a domain then the name will be cancelled and you will no longer have any rights to use that domain name.
Making an Offer on a Domain
You make an offer on a domain name by completing the offer process on the web site or by emailing us.
All offers are subject to VAT being added at the prevailing rate unless the domain is paid for and registered outside of the European Union.
On receipt of your offer we will either provisionally accept or reject your offer and email you accordingly.
In the event that we provisionally accept your offer then payment must be received within seventy two hours (three calendar days) or the offer may expire.
If you pay by PayPal then PayPal may present you with a receipt on screen and/or email you confirmation of your payment. Any such PayPal receipt or confirmation is not acceptance by us of any offer to purchase a domain name.
Your offer and our provisional acceptance does not form a binding contract until payment has been received and the domain transfer initiated with Nominet.
Buying a Domain from us
You make an offer to purchase from us by completing the order process on the web site or by emailing us. Your offer to purchase does not form a binding contract until it is accepted by us.
All prices displayed on our web site exclude VAT.
On receipt of your order, we may send you an order acknowledgement to the email address you provided. This order acknowledgement email will contain details of the domain ordered. This email is only to acknowledge that your order has been received and is being reviewed. It is not acceptance by us of any offer to purchase a domain name.
If you pay by PayPal then PayPal may present you with a receipt on screen and/or email you confirmation of your payment. Any such PayPal receipt or confirmation is not acceptance by us of any offer to purchase a domain name.
Order acceptance and the formation of a binding contract between you and us only takes place when we initiate the domain transfer with Nominet. From that point on you have control of the domain and are fully responsible for the domain; in particular you must ensure the domain is renewed with Nominet should you wish to keep using it past the expiry date.
Please note that to transfer a domain you must confirm that you are aware of, and accept in full, the current Nominet terms and conditions.
You make an offer to lease from us by completing the leasing order process on the web site or by emailing us. Your offer to lease does not form a binding contract until it is accepted by us.
On receipt of your order, we may send you an order acknowledgement to the email address you provided. This email is only to acknowledge that your order has been received and is being reviewed. It is not acceptance by us of any offer to lease a domain name.
If you pay by PayPal then Paypal may present you with a receipt on screen and/or email you confirmation of your payment. Any such PayPal receipt or confirmation is not acceptance by us of any offer to lease a domain name.
A lease agreement and the formation of a binding contract between you and us only takes place when we accept your offer and update the DNS details for the domain:
- Domains remain the property of Zycon unless and until the option to buy is paid for in full and the Nominet transfer process completed in full.
- Once the first monthly payment is received we will update the DNS at your request to give you full DNS control over the use of the domain.
- Each agreed monthly payment received entitles you to use the domain for the following 30 days.
- Leases are offered on a minimum 3 month contract for a maximum of 24 months and you can terminate the lease at any time after three monthly payments have been made.
- If payment is not received within 7 days of the agreed due date the DNS details may be temporarily removed.
- If payment is not received within 14 days of the agreed due date the lease agreement will be terminated and all rights to use the domain will be lost.
- You have the exclusive right to buy the domain at the fixed pre-agreed price at any time within 24 months unless the lease agreement has been terminated.
- The domain name must not be used for spam, illegal content or activities, or anything contrary to the relevant sections of Nominet’s standard terms and conditions of domain name registration and use. Breaching this condition may lead to the DNS details being removed and/or the lease agreement being immediately terminated.
- All prices exclude VAT which will be charged at the prevailing rate.
- The lease agreement is subject to the laws of England, Scotland and Wales.
Please note that to lease a domain you must confirm that you are aware of, and accept in full, the relevant sections of the current Nominet terms and conditions.
Rejecting your Offer
Unless you are exercising your option to buy at a pre-agreed price under a lease agreement, we reserve the right not to accept your offer to purchase a particular domain name. In the event that you have already made a payment and we have not initiated the domain transfer then we will refund that payment in full within seven working days of your request to do so.
We reserve the right not to accept your offer to lease a particular domain name and will refund any first payment in full within seven working days of your request to do so.
Domain Transfers
Once we have received payment and accepted your order to purchase a domain we will initiate the domain transfer via Nominet.
Nominet will email the purchaser a link to a secure form. Please note that if you pay by PayPal then your PayPal email address will be used.
Nominet’s rules state that you must pay the £10 + VAT transfer fee (if applicable) and complete the transfer within five days or the transfer will expire.
In the event that you do not complete the transfer within five days we will restart the transfer process on request where it is reasonable to do so. If you do not complete the transfer before the domain Expiry Date you may lose all rights to the domain and will not be entitled to a refund.
Controlling a Domain and Updating the DNS
Once we initiate the domain transfer you have control of the domain and can update the DNS and/or transfer the domain to another registrar.
If you have completed the transfer process with Nominet and left the registrar as ZYCON then you will be emailed login details to allow you to update the DNS online.
If you have completed the transfer process with Nominet and transferred to another registrar then their customer service department can advise on how to update the DNS.
If you have not yet completed the transfer process then email dom@zycon.co.uk with the new DNS details and we will manually update the DNS within 24 hours.
Cancelling Your Order – Consumer Contracts Regulations 2013
If you are a Consumer (a natural person who is acting for the purposes other than those of his trade, business or profession) then you have certain rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Under these regulations you must notify us in writing or by email that you wish to cancel your contract before the end of the statutory cancellation period of 14 days after the initial transfer was actioned.
You can only cancel your contract using the Consumer Contracts Regulations if the Registrant, Registrar and/or DNS for the domain have not been updated by you or your agent (which may include Zycon if you asked us to update such details.) By completing the Nominet domain transfer process you will be giving your express consent to waive these cancellation rights.
Unsolicited Emails and Messages
We do not send Unsolicited Emails (spam) to internet users and do not appreciate others sending us spam.
We may send one email to you if we believe a domain we own may genuinely be of interest and we are happy for others to send us one email if they have a domain that genuinely may be of interest to us.
Any unsolicited emails or messages not to do with the buying/selling of domains or any email sent to more than one of our contact addresses or multiple emails sent about the same subject are likely to get you listed on the Zycon Hall of Shame for everyone to see. It is a condition of using our web site that you hereby give us permission to publish your email address in such cases. If you do not wish to accept this condition then please do not use our site or contact us.
